Terms
and Conditions
These
Terms and Conditions, together with any specific conditions set out in the
Auction Catalogue govern any participation in this charitable auction (the
“Auction”).
By
participating in the Auction, anyone who takes part as “a
Bidder” will be deemed to have understood these Terms and Conditions
and to be bound by them.
Bidders
must be aged 18 years or over and have a valid means of paying if winning
an item.
This
Auction is promoted by Des Shepherd (on behalf of Thomas@18) (the “Promoter”)
1.
The auctions and bidding process
1.1
The Auction will run from (start date) and 5pm
on Saturday 10 May 2025 (“the
Bid Period”);
1.2
Individuals wishing to place a bid can do so from the beginning of
the Term by accessing the Auction website, www.thomasat18.co.uk/auction
(the “Site”) from which the Bidder will be directed to place
their bid;
1.3
Bidders will receive a confirmation email following the placement
of any bid within 24 hours of receipt of the bid by the Promoter. Bidders
can check the progress of the bids on the website which will be updated
every evening.
2.
Legal status of bids
Each placement of a bid will constitute a legal offer which, on
acceptance by the Promoter, will form an agreement which will be binding
on the Bidder.
3.
Lots
3.1
The Auction Catalogue (the “Catalogue”),
is available online and in print and
contains a detailed description of each individual Lot;
3.2
All Lots that are offered for auction have been offered by third
parties (each a “Donor”) for the sole purpose of raising funds for the
Thomas@18 fundraiser;
3.3
Lots are donated with the expectation that Bidders will respect the
donors’ generosity and abide by any specific rules and conditions;
3.4
Participants acknowledge that information provided as a description
of any individual Lot is reproduced by the Promoter in good faith and is
consistent with information supplied to the Promoter. As such, the
Promoter cannot be held responsible for inaccurate or misleading
descriptions.
4.
The winning bid
4.1
The Bidder who has placed the highest bid by the end of the Term
(5pm on Saturday 10 May 2025) shall be the winning bidder (the
“Winning Bidder”);
4.2
In the event that more than one bidder has submitted the highest
bid, the winning bidder will be the first bid received by the Promoter;
4.3
Where a Bid is successful, the Bidder will be contacted by Promoter;
4.4
If any dispute arises as to the identity of the Winning Bidder, the
Promoter shall have absolute discretion;
4.5
The Winning Bidder of a lot has no right to sell on to third
parties, sublet or assign without the prior agreement of both the Promoter
and Donor.
5.
Payment
5.1
The successful Bidder must
complete the payment by Monday 19 May 2025;
5.2
Payment must be made by BACS (bank transfer);
5.3
Winning Bidders should ensure reference is made to the relevant
Auction Lot number:
5.4
In the event that the Lot is not paid in full by Monday 19 May 2025,
the Promoter may offer the Lot to the next highest bidder:
5.5
Ownership of a Lot shall not pass to the Winning Bidder until
payment is received in full.
6.
Liability
6.1
The Promoter endeavours to ensure that the information and other
material on the Site and in the Catalogue are correct and complete, but
does not accept liability for any errors in or omissions from the
information provided:
6.2 The Promoter will use all reasonable efforts to correct errors
and omissions as quickly as practicable after being notified of them.
Data
Protection Act 2018
In registering with this auction, bidders consent to their information
(“the Information”) being
used as reasonably necessary for the purpose of the auction. The Promoter
will use the Information only as needed in connection with the auction,
keeping it secure and not disclosing the Information to other parties.
